By visiting the Site you are accepting the practices described in this Privacy Policy.
Modifications.
We reserve the right to change any of the terms of this Policy at any time and in our sole discretion. Any changes will be effective upon posting on the Site and we will use reasonable measures to ensure that changes are prominently posted in a manner designed to afford notice to users of the Site. You are responsible to periodically check for the most current terms that apply to your transactions on the Site. YOUR CONTINUED USE OF THIS SITE AND THE SERVICES FOLLOWING THE POSTING OF ANY CHANGES WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGES. IF YOU DO NOT AGREE TO THE CHANGES, DO NOT CONTINUE TO USE THE SERVICES OR THIS SITE.
What Personal Information About Customers Does Benji Frank Gather?
The information we learn from customers helps us personalize and continually improve your shopping experience at Benji Frank. Here are the types of information we gather.
Information You Give Us: We receive and store any information you enter on our Site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, customizing future shopping for you, improving our stores, and communicating with you.
Automatic Information: We receive and store certain types of information whenever you interact with us. For example, like many web sites, we use "cookies," and we obtain certain types of information when your web browser accesses Benji Frank or advertisements and other content served by or on behalf of Benji Frank on other web sites.
E-mail Communications: To help us make e-mails more useful and interesting we often receive a confirmation when you open e-mail from Benji Frank if your computer supports such capabilities. We also compare our customer list to lists received from other companies in an effort to avoid sending unnecessary messages to our customers.
Information from Other Sources: We might receive information about you from other sources and add it to our account information.
What about Cookies?
Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser to enable our systems to recognize your browser and to provide features recommended for you such as personalized advertisements on other web sites (e.g., Benji Frank affiliates with content served by Benji Frank and web sites using checkout by Benji Frank payment services), and storage of items in your Shopping Cart between visits. The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-ons settings or visiting the web site of its manufacturer. However, because cookies allow you to take advantage of some of Benji Frank's essential features, we recommend that you leave them turned on.
Does Benji Frank Share the Information It Receives?
Information about our customers is an important part of our business and we are not in the business of selling it to others. We share customer information only as described below and with subsidiaries controlled by Benji Frank that either are subject to this Privacy Policy or follow practices at least as protective as those described in this Privacy Policy.
Affiliated Businesses We Do Not Control. We work closely with affiliated businesses. In some cases these businesses sell offerings to you at Benji Frank. In other cases, we operate stores, provide services, or sell product lines jointly with these businesses. You can tell when a third party is involved in your transactions and we share customer information related to those transactions with that third party.
Third-Party Service Providers. We may employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions but may not use it for other purposes.
Promotional Offers. Sometimes we send offers to selected groups of Benji Frank customers on behalf of other businesses. When we do this we do not give that business your name and address.
Business Transfers. As we continue to develop our business we might sell or buy stores, subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the customer consents otherwise). Also, in the unlikely event that Benji Frank or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.
Protection of Benji Frank and Others. We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Benji Frank, our users or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in this Privacy Policy.
With Your Consent. Other than as set out above, you will receive notice when information about you might go to third parties and you will have an opportunity to choose not to share the information.
How Secure Is Information About Me?
We work to protect the security of your information during transmission by using software that encrypts information you input. We reveal only the last four digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer. We take the security of your data very seriously and employ all reasonable measures to protect it. Ultimately, however, no system for transmitting data over the internet is completely secure and we do not guarantee the security of data transmitted between your computer and our servers or otherwise in connection with the Site and you provide your information to us at your risk.
What about Third-Party Advertisers and Links to Other Websites?
Our site includes third-party advertising and links to other web sites. We do not provide any personally identifiable customer information to these advertisers or third-party web sites. These third-party web sites and advertisers, or Internet advertising companies working on their behalf, sometimes use technology to send the advertisements that appear on our web site directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, JavaScript, web beacons (also known as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and to personalize advertising content. We do not have access to or control over cookies or other features that they may use and the information practices of these advertisers and third-party web sites are not covered by this Privacy Policy. Please contact them directly for more information about their privacy practices. Benji Frank also displays personalized third-party advertising based on personal information about customers, such as purchases on Benji Frank, visits to Benji Frank Affiliate web sites, or use of payment services like Checkout by Benji Frank on other web sites. Although Benji Frank does not provide any personal information to advertisers, advertisers (including ad-serving companies) may assume that users who interact with or click on a personalized advertisement meet their criteria to personalize the ad.
What Information Can I Access?

What Choices Do I Have?
As discussed above, you can always choose not to provide information, even though it might be needed to make a purchase or to take advantage of Benji Frank features. You can add or update certain information on pages. When you update information, we usually keep a copy of the prior version for our records. If you do not want to receive e-mail or other mail from us, please adjust your Preferences. If you do not want to receive Terms of Use updates, Policy updates and other legal notices from us those notices will still govern your use of the Site and it is your responsibility to review them for changes.

If you choose to visit Benji Frank, your visit and any dispute over privacy is subject to this Policy and our Terms of Use, including limitations on damages, resolution of disputes, and application of the laws of the State of Texas, USA. If you have any concern about privacy at Benji Frank, please contact us with a thorough description and we will try to resolve it. Our business changes and our Privacy Policy and Terms of Use will change also. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. We stand behind the promises we make and will not materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
